Question
I was recently convicted for being drunk and disorderly, and fined £80. At the time of arrest, the police asked me to provide a DNA test, and left me feeling like I had no choice. Having paid the fine, and got on with my life, the police now want me to take the test again as the results weren't clear. They've even threatened me with a warrant for my arrest unless I show up within seven days. Can they do this?
Answer
As you have a conviction, the police are entitled to ask you to provide a DNA sample. As the initial sample was compromised, the police are still able to request a repeat test.
Unfortunately, not everyone who has a conviction is as cooperative as you have been so far, because some people try and avoid giving a sample. As a result, the police have been given the power of arrest to ensure that samples are given.
In this view, it's advisable for you to offer your full cooperation, without taking the legal threats too personally.
